Due to an increase in the number of claims we’ve received, response times may be longer than usual
All local roads are managed and maintained by Council with the exception of declared Main Roads, which are the direct responsibility of Transport for NSW.
When dealing with claims, Council has certain protections from liability under the NSW Civil Liability Act 2002. Accordingly, Council may not be liable for damages arising from potholes and other hazards unless Council was aware of the risk and acted negligently by not addressing the issue.
Council recommends that you seek professional legal advice if you are unsure as to whether you are able to claim for your loss or damage.
Should you wish to make a claim against Council, please complete the claim for compensation form and include all relevant documentation. An example of appropriate documentation for damage to vehicles is listed below:
- Photograph showing the road surface issue / pothole in wider context (eg. near a landmark)
- If photograph is not available, provide a description of the issue and a screenshot of a map with location clearly marked
- Evidence of vehicle damage including photographs of the damage
- Evidence of ownership of the vehicle including
- Owner’s name
- Vehicle registration number
- Photograph of valid driver’s licence
- Evidence of the quantum of compensation sought, such as a tax receipt or quote.
