By submitting an entry into the Keeping Cats at Home Competition 2022 (Competition) held by Northern Beaches Council ABN (57 284 295 198) in partnership with the RSPCA NSW, each entrant (You) acknowledge and agree to the following terms and conditions.

1. Entry
 

  • a) The Competition is free to enter.
  • b) You must be 18 years or older to enter the Competition.
  • c) You must be an Australian citizen or have permanent resident status in Australia to enter the Competition.
  • c) You must reside in the Northern Beaches Local Government Area.
  • d) Employees of Council and the RSPCA NSW are ineligible to enter the Competition.
  • e) By submitting an entry into the Competition, you agree to Council and the RSPCA collecting your personal information for the purposes of assessing your Competition entry.  The collection of your personal information is in accordance with the RSPCA NSW Privacy Policy and Northern Beaches Council Privacy Policy and the use of your personal information is in accordance with those policies.
  • f) You can submit a maximum of one entry to the Competition.  If multiple entries from you are received by Council, only the first entry received first will be eligible for consideration.
  • g) You may submit one photograph with your entry.
  • h) Your photograph must have been taken in Australia within the last 12 months.
  • i) The Competition commences on Wednesday 1 March 2023 . You must submit your entry to Council by Sunday 9 April 2023. Late or lost entries will not be considered.
  • j) By entering the Competition, you acknowledge and accept these terms and conditions.
  • k) Council may cancel or vary the Competition or these terms and conditions at any time.
  • l) Council will not be responsible for any loss or costs incurred by you in relation to such cancellation or variation.

 

2. Judging entries

  • a) Valid entries in the Competition will be judged by a judging panel comprising Council and RSPCA staff.
  • b) The decision of the judging panel is final and no correspondence will be entered into in respect of the judging panel’s decisions.
  • c) Winners will be notified by email or phone by a representative of Council.

 

3. Prizes

  • a) There are up to 10 $1000 vouchers from catnets to be won.
  • b) The number of vouchers awarded will depend on the quality of the photos received.
  • c) Winners must use their winning voucher to buy a cat enclosure from catnets. The prize is strictly valid as an online store credit at www.catnets.com.au.  Cat enclosures can be used for a home with a backyard or for an apartment with a balcony (although you may need to check with your owner’s corporation for balcony use).
  • d) Winners can supplement their cat enclosure prize of up to a total of $1,000 with other cat accessories such as cat outdoor furniture or climbing platforms from catnets.com.au
  • e) Please note the voucher does not cover the cost of installing your cat enclosure, although catnets do have freestanding or portable enclosures available and can also recommend installers. Installation will be at the prize winner’s expense.
  • f) Vouchers are not redeemable for cash.
  • g) Vouchers must be used within 12 months. Any issue with a catnets product is the responsibility of catnets under their product and service terms and conditions.
  • h) Winners agree to participate in Council’s and RSPCA NSW future promotions of the Cat Safe at Home program. This may involve providing quotes of a winner’s experience with their prize of a cat enclosure, including a photo of their completed enclosure in their home or apartment. These images may be used on Council’s, RSPCA NSW and catnets promotion channels including newsletters and social media.

 

4. Copyright and moral rights

  • a) You grant Council and the RSPCA NSW, and all sponsors and partners of the Competition, an irrevocable worldwide licence to reproduce, publish, and communicate to the public your photograph (or any part of it.
    • in any media format, including but not limited to advertisements, postcards, brochures, posters, television/print media, websites, social media, apps, publications and reports;
    • for the purposes of:
      • i) The Competition, including any associated event or exhibition;
      • ii) publicity and promotion of the Competition;
      • iii) publicity and promotion of Council or the RSPCA NSW including media and marketing campaigns;
      • iv) any archive of Council or the Competition.
  • b) You acknowledge and agree that Council and the RSPCA NSW may adapt your photograph, including but not limited to adapting the photograph for the online gallery, for any large format reproduction for exhibition, or for use in Council or RSPCA NSW, catnets media and marketing campaigns.
  • c) You warrant that you are the owner of all intellectual property rights in the photograph, or have obtained all necessary approvals and consents to permit the entry of the photograph into the Competition and for use of the photograph in accordance with these terms and conditions.
  • d) Photography that infringes the intellectual property rights of any person will be immediately removed from the Competition and you must return to Council any prize given to you by Council in winning the Competition.
  • e) Council, the RSPCA NSW and catnets will use its best endeavours to acknowledge you in all Competition publicity as the creator of the photograph.

 

5. Release and indemnity

  • a) You release Council, the RSPCA NSW and all sponsors and partners of the Competition, from any claim, damage, expense, loss, cost or liability with respect to:
    • the infringement of your moral rights in respect of your photograph; and
    • the use of your photograph by Council, the RSPCA NSW or the sponsors and partners of the Competition.
  • b) You indemnify Council, the RSPCA NSW and the sponsors and partners of the Competition, against any claim, damage, expense, loss, cost (including reasonable legal costs) or liability (including liabilities of Council to third parties) arising out of or in connection with:
    • infringement of any intellectual property rights in respect of your photograph;
    • use of your photograph by Council, the RSPCA NSW or the sponsors and partners of the Competition.
