Notice is hereby given that Council is proposing to close a portion of Council road reserve within the Manly Andrew Boy Charlton Aquatic Centre.
The purpose of the proposed closure is to rectify a long-standing administrative matter and allow the land to be reclassified as Community Land. This will align the legal status of the land with its existing and intended use as part of the aquatic centre facility.
Any person is entitled to make submissions concerning the proposal within 28 days of the date of this public notice.

Once the submission period is completed, Council will consider all duly made submissions before deciding whether to continue with the road reserve closure proposal.

What is the purpose of this proposed road reserve closure?
The purpose of this proposed road reserve closure is to rectify a long-standing administrative anomaly. A portion of the Manly Andrew Boy Charlton Aquatic Centre (MABC) building was found to encroach onto an unclosed road reserve. The closure will allow Council to reclassify the land as Community Land, aligning its legal status with its existing and intended use as part of the aquatic centre facility.
Where is the proposed road reserve closure?
The proposed road reserve closure is located on the eastern side of the MABC building and includes part of the cafe premises. Please refer to notification plan.

Do local residents currently use this road reserve area?
This road reserve is currently being used by local residents as part of the built structure of the aquatic centre.
How did Council gain possession of this road reserve land?
Historical investigations revealed that the land was originally created as a private road prior to 1920 and had never been formally dedicated to Council. As no historical gazettal could be found, Council undertook the statutory process under Section 16 of the Roads Act 1993 to dedicate the land as public road. This dedication was gazetted on 8 September 2023 and finalised on 20 October 2023.

What happens after the public notification closes?
- Council staff will review all submissions from the public, as well as internal and external stakeholders.
- This proposal including a summary of all submissions received will be reported to a future Council meeting for consideration.
